Dear Mr. Denton:

Pursuant to your Order of June 25, 1979 calling for modifi-cation of Antitrust License Condition No. 3, The Cleveland Electric Illuminating Company ("CEI") hereby requests an opportunity to be heard on the following two issues set out in said Order:

(1) whether CEI has been in noncompliance with Antitrust License Condition No. 3 since January 27, 1978, the date it filed its first transmission tariff with FERC; and (2) if so, whether this Order [of June 25, 1979]

should be sustained.

CEI maintains that it has not been "in nonccmpliance with Antitrust License Condition No. 3 since January 27, 1979", and c, V, oops . O A

However, with certain language modifi-cations to the proposed Transmission Service Tariff attached as Appendix E to said Order, CEI would have no objection to filing that tariff with FERC, as so modified, insofar as it conforms with the final Order issued by the Federal Energy Regulatory Commission in FERC Docket No. ER 78-194.
