Dear Commission:
As -counsel for the Ohio Citizens for Responsible
- Energy, Inc.
(OCRE),
we are writing to request the scheduled meeting of the Commission on September 5, 1986 at 10:00 a.m., be stayed pending a
decision from the United States Court of Appeals For the Sixth Circuit in Ohio Citizens for Responsible Energy v. N.R.C.,
No.
86-3355.
The Commission meeting scheduled on Se'ptember 5,
1986 regards Discussions /Possible Vote on Full Power Operating License for Perry-1.
[51 Fed Reg 29043 (August 13, 1986)].
OCRE has filed a Motion.For A Continuance with the Commission on August _27, 1986.
[ attached Exhibit 1].
The reasons contained in OCRE's Motion are incorporated herein as reasons for requesting the stay instanter.
We are further advising that OCRE intends to seek a Stay Pending Review in the United States Court of Appeals For the Sixth Circuit in the event the Commission denies OCRE's pending Motion.
Pursuant to Fed.
R.
App.
P.
18 and Chapter 19.5 of time Internal Operating Procedures for the Sixth Circuit, OCRE will give notice on August 29, 1986 to the Court of Appeals and to the Parties that said emergency motion may be filed.
