Docket Nos. 50-440 and 50-441 Petition for.Immediate Action Dear Dr. Murley On January 22, 1988, Oh:
Citizens for Responsible Energy submitted to you a "Petition tor Immediate Action to Relieve Undue Risk Posed by the Inadequate Seismic Design of the Perry Nuclear Power Plant."
The Petition requests the immediate suspension of the operating license for the Perry Nuclear Power Plant, Unit 1, and the construction permit for Perry Nuclear Power Plant, Unit 2.
By letter dated March 2, 1988, you declined to order the immediate suspension of the operating license and construction permit but stated that the Commission would continue to study the matter and to 11 sue a formal Decision.
Cleveland Electric Illuminating Company, on behalf of itself and the co-owners of the Perry facility ("Licensees") hereby submit a technical report which responds to the Petition and to the Affidavit of Dr. Yash P. Aggarwal and the Report of Dr.
Aggarwal submitted with the Petition.

Nuclear Regulatory Commission June 8, 1988 Page 2 concludes that there is no geoscience or seismological data that supports the presence, postulated by Dr. Aggarwal, of a 70 kilo-meter long fault capable of producing a magnitude 6.5 earthquake in the vicinity of the Perry facility.
The enclosed report includes new data and analysis on the geology and seismology of the Northern Ohio area and integrates this information into the existing historical data.
Licensees request that the enclosed report be considered in the formal Decision in this matter.
