Gentlemen:

On August 8, 1986, intervenor Ohio Citizens for Responsible Energy ("OCRE") filed a petition to reconsider portions of the Appeal Board's July 25, 1986 decision, ALAB-841.

In view of the Appeal Board's guidance that it "will never be necessary for a party to respond to a petition for reconsider-ation filed with the Appeal Board unless that Board has specifi-cally requested it to do so," Maine Yankee Power Co. (Maine Yan-kee Power Station), ALAB-166, 6 AEC 1149, 1150 n.7 (1973), see also Houston Lighting and Power Co. (Allens Creek Nuclear Generating Station, Unit 1), ALAB-544, 9 NRC 630, 631 (1979);

Metropolitan Edison Co. (Three Mile Island Nuclear Station, Unit No. 1), ALAB-766, 19 NRC 981, 983 n.6 (1984), Licensees will await the Appeal Board's decision whether to request such re-sponse.

August 12, 1986 Page 2 Lice ~nsees would note, however, that OCRE's petition appears not to have been filed within the time limit established by the Commission's Rules of Practice and was filed without a motion for leave to file out-of-time or a showing of good cause for its un-timely filing. The regulation governing the filing of petitions for reconsideration, 10 CFR S 2.771(a), provides that such peti-tions are to be filed "within ten (10) days after the date of the decision." Since ALAB-841 was dated July 25, 1986, the ten day period for filing a petition expired on August 4, 1986. The five days allowed for service by mail is not added in this case.

Under 10 CFR S 2.710, the additional five days are only available when "a party has the right or is required to do some act within a prescribed period after the service of a notice or other paper upon him or her and the notice or paper is served upon by mail...." (emphasis added). Here the 10-day prescribed period is after the date of the decision rather than the service of the de-cision. OCRE's filing was therefore untimely.
