Dear Ms. Bauman:

This is in response to your letter dated January 18, 1989, in which you appealed Mr. Donnie H. Grimsley's response dated January 9,.1989.

Mr. Grimsley's response denied portions of one record subject to your Freedom of Information Act (F0IA) request for copies'of all records related to the inspection for August 3,1988 - September 8,1988 at the Comanche Peak Plant and to the discussions of findings with Mr. Counsil et al., at the conclusion of the inspection. You specifically appealed the denial of portions of the record identified on the enclosed Appendix C of Mr. Grimsley's response dated January 9, 1989.

Acting on your appeal, I have carefully reviewed the record in this case and have determined that the previously withheld information will continue to be withheld from public disclosure. Therefore, your appeal is denied. The withheld portions of the record corsist of names of two individuals and other identifying information the discloture of which would cause a clearly unwarranted invasion of personal privacy. This information will continue to be withheld from public disclosure pursuant to Exemption (6) of the F0IA (5 U.S.C. 552(b)(6))

and 10 CFR 9.17(a)(6) of the Commission's regulations. I am unable to identify any legitimate public interest in the release of this information which outweighs the privacy interests of the individuals.

This is a final agency decision. As set forth in the F0IA (5 U.S.C.

552(a)(4)(B)), judicial review of this decision is available in a district court of the United States in the district in which you reside or have yout principal place of business or in 'ae District of Columbia.
