REQUEST FOR EXEMPTION FROM APPENDIX R TO 10 CFR PART 50 FOR WATERFORD STEAM ELECTRIC STATION, UNIT 3 (TAC NO. M98144)

Dear Mr. Dugger:

By letter dated February 19,1997, as supplemented by letters dated May 20 and July 25,1997, Entergy Operations Inc., (EOl), requested an exemption from certain technical requirements of Section 111.0 of Appendix R to Part 50 of Title 10 of the Code of Federal Regulations (10 CFR Part 50). Specifically, the EOl proposed to be exempt from installing a lube oil collection system under lube oil fill tubing which was added at Waterford Steam Electric Station, Unit 3 (Waterford 3), in 1986 and 1990.

10 CFR 50.48 specifies that Appendix R, Section Ill.0, applies to nuclear power plants licensed to operate prior to January 1,1979. Waterford 3 was licensed to operate on March 16,1985.

However, by letter dated November 10,1981, Louisiana Power & Light committed to meet the technical requirements of Appendix R to 10 CFR Part 50. Therefore, the staff treated the exemption request as a deviation from the commitment to meet Section 111.0 of Appendix R.

We have reviewed your request for deviation and found it acceptable. Our safety evaluation is
