Dear Mr. Gunnigle:

The Nuclear Regulatory Commission (NRCI has received your letter dated April P0, 1987, regarding your concern relative to the licensing of Vogtle Unit 1 prior to completion of " required safety tests." The NRC issued the Vogtle linit I low-power license on January 16, lor 7 Initial criticality was achieved on March 9, and full-power licensing followed on March 16, 1987 We believe that the incomplete safety tests to which you refer are certain preoperational tests from which Georgia Power Company (the licenseel requested schedular relief. Specifically, the licensee requested that certain pre-operational testing of specified systems be delayed until after issuance of the low-power license. The preoperational tests requested to be deferred included certain portions of the reactor coolant system hot functional testing, the digital radiation monitoring system, the piping penetration filter exhaust, the breathing air system inside containment, and the post-accident monitoring system. The systems for which deferral was requested are not necessary to ensure safety before the reactor has achieved initial criticality.

The NRC staff fully reviewed the licensee's reouest in accordance with Title 10 of the Code of Federal Regulations, Part 50.57(bl which states: "Each operatina license will include appropriate provisions with respect to any uncompleted items of construction and such limitation or conditions as are required to assure that operation during the period of the completion of such items will not endanger public health and safety." Upon completion of its review, the staff was able to conclude that public health and safety would continue to be protected if the requested tests were deferred beyond @el load but completed before systems are needed to ensure plant safety, i believe that the above addresses your concern relative to the licensing of Vogtle I! nit 1.
