JUL 11 1986 Docket Nos. 50-424/425 Ms. Lauri Fowler, Esquire Georgia ACLU Suite 220 - Grant Building IN RESPONSE REFER 44 Broad Street, NW TO F01A-86-43 AND Atlanta, GA 30303 F01A-86-A-31
Dear Ms. Fowler:
ibis is in further response to your letter dated January 15, 1986, in which you requested, pursuant, to the Freedom of Information Act (F0IA), all documents related to the NRC investigation into the complaints of Susan Register, Leslie Price, and James B. Register regarding alleged illegal and improper procedures and practices at the Vogtle plant located in Waynesboro, Georgia.
The documents listed on the enclosed Appendix D are records compiled for law enforcement purposes and are being withheld from public disclosure pursuant to Exemption (7)(A) of the F0IA (5 U.S.C. 552(b)(7)(A)) and 10 CFR 9.5(a)(7)(i) of the Commission's regulations. Disclosure of the information would interfere with an ongoing enforcement proceeding and could allow those being inves igated to learn the scope, direction, and focus of investigatory efforts. That know-ledge could possibly allow them to take action to shield potential wrongdoing or a violation of NRC requirements from investigators.
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The person responsible for this denial is Mr. Ben B. Hayes, Director, Office of Investigations.
This denial may be appealed to the Secretary of the Commission within 30 days from the receipt of this letter. Any such appeal must be in writing, addressed to the Secretary of the Commission, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision."
This completes action on your request. Also, in light of our responses of March 28, 1986, May 2, 1986, and this date, no further action will be taken on your letter of March 5,1986, appealing our lack of response to this F0IA request.
)
Sincerely, 8607180388 860711
