Dear Mr. Teper:

This will acknowledge receipt of your January 9, 1987, letter notifying us that you will be representing GANE in the oral argument scheduled for January 21, 1987.

The Board has asked me to point out that Commission policy, by which appeal boards are bound, provides that appellate arguments generally are held in Bethesda, Maryland. See 10 CFR Part 2, Appendix A, IX(e) . However, appeal boards are prepared to entertain timely requests to move oral argument to another location if there is an adequate demonstration of hardship to a party. See, for example, Wisconsin Electric Power Co. (Point Beach : Nuclear Plant, Units 1 and 2), ALAB-666, 15 NRC 277, 279-80 & n.5 (1982). You made no such request in this case and, in any event, now indicate that you can participate in the oral argument as scheduled.
