This is in response to your letter dateo June 15, 1987, in which you appealed

Mr. Donnie H. Grimsley's form response dated May 14, 1987.

Mr. Grimsley's

form response denied three documents, in whole or part, which were subject to

your Freedom of Information Act (F0IA) request for documents regarding

Inspection Report 50-424/86-91 dated November 13, 1986, concerning drug abuse

at Alvin W. Vogtle nuclear plant.

Acting on your appeal, I have carefully reviewed the record in this case and

have detennined that the previously withheld information will continue to be

withheld from public disclosure pursuant to Exemption (6) of the F0IA (5

U.S.C. 552(b)(6)) and 10 CFR 9.5(a)(6) of the Coninission's regulations. Your

appeal is, therefore, denied.

The withheld information in document one listed on the enclosed appendix

consists of the names, social security numbers, dates of termination, and the

reasons for termination of individuals whose employment was terminated due to

positive test results for the use of drugs and/or alcohol. The withheld

information in documents two and three listed on the enclosed appendix

consists of the names and other identifying information of individuals who

consented to being interviewed by the inspection team concerning their

experience at the site and the utility's handling of matters pertaining to

orug and alcohol abuse.

I am unable to identify any legitimate public

interest in this information which outweighs the privacy interests of the

individuals.

This is a final agency action. As set forth in the F0IA (5 U.S.C.

552(a)(4)(B)), judicial review of this decision is available in a district

court of the United States iri the district in which you reside or have your

principal place of business or in the District of Columbia.
