SUBJECT

NRC INSPECTION REPORT 50-382/98-17 AND NOTICE OF VIOLATION

Dear Mr. Dugger:

From October 5 8,1998, a radiation protection inspection was conducted at your Waterford

Steam Electric Station, Unit 3 reactor facility. The enclosed report presents t' scope and

results of that inspection.

In general, we determined that you have implemented an effective radiation protection program.

However, the inspection identified two violations of NRC requirements.

These violations are cited in the enclosed Notice of Violation (Notice) and the circumstances

surrounding the violations are described in detailin the enclosed report. The violations involved

the failure to: (1) survey an overhead work area prior to workers entering the area, and (2) limit

the hours worked by an acting health physics supervisor to not more than 72 hours8.333333e-4 days <br />0.02 hours <br />1.190476e-4 weeks <br />2.7396e-5 months <br /> in a 7-day

period. The second violation is similar to a violation identified in inspection Report 382/97-04.

Please note that you are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. The NRC will use your

response, in part, to determine whether further enforcement action is necessary to ensure

compliance with regulatory requirements.

Regarding Violation A, the NRC has concluded that information regarding the reason for the

violation, the corrective actions taken and planned to correct the violation and prevent

recurrenco is already adequately addressed on the docket in the enclosed inspection report.

Therefore, you are not required to respond to Violation A, unless the description therein does

not accurately reflect your corrective actions or your position. In that case, or if you choose to

provide additional information, you should follow the instructions specified in the enclosed

Notice.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its

enclosure (s), and your response will be placed in the NRC Public Document Room (PDR).
