Dear Mr Fouch:

I am responding to your July 10,1998, letter in which you requested exemption from the FY 1998 annual fee requirement of 10 CFR Part 171.15 for the U.S. Geological Survey's (USGS) research reactor in Denver. The bases for the exemption are unchanged from those provided in previous years and USGS continues to meet the exemption criteria specified in 10 CFR 171.11(a)(2).

The final rule which became effective August 10,1998, grants exemption from the FY 1998 annual fee for the U.S. Geological Survey's research reactor in Denver. For subsequent years, you must continue to certify that you meet the exemption criteria specified in 10 CFR 171.11(a)(2).
