This is in response to your letter dated March 19, 1986 which transmitted revised Section 3.4.1.3, Revision 5 - March 1986 - page 3.3 (as amended by Revision 6 dated April 1986) of your Fundamental Nuclear Material Control (FNMC) Plan. The submittal was made under the provisions of 10 CFR 70.34 to cover the contractual receipt, measurement and processing of low enriched UF6 cylinder heels.

We have determined that the described procedures and revision to the FNMC Plan are acceptable in that neither the common defense and security nor the public health and safety would be adversely affected and are otherwise in the public interest. Accordingly, we are revising License Condition 2.1 to Amendment MPP-3 to your License No. SNM-33, effective immediately, to read as follows:

2.1 The licensee shall follow the Fundamental Nuclear Material Control (FNMC) Plan dated January 1977; as amen De mber 1977, April 1978, February 1979, and pages marked Revision 2 - Fe ruary 1981, Revision 3 - January 1985 (as approved by Region III May 30, 1985),

Revision 4 - September 1985, Revision 6 - April 1986; and as revised in accordance with the provisions of 10 CFR 70.32(c).

Per a telephone conversation between H. E. Eskridge and R. L. Jackson,it has l been determined that the attachment to your March 19, 1986 letter and l Revision 6 dated April 1986 contain information of the type specified in 10 CFR 2.790(d). Accordingly, pursuant to Section 2.790(d)(1), such information is deemed to be commercial or financial within the meaning of 10 CFR 9.5(a)(4), and shall be withheld from public disclosure, unless subject to the provisions of 10 CFR 9.12.
