' REQUEST FOR TIME EXTENSION TO REPORT THE RESULTS OF THE PHYSICAL INVENTORY (TAC NO. L31197)

Dear Mr. Sharkey:

in accordance with your correspondence dated May 20,1999, and pursuant to Part 70 to Title 10 of the Code of Federal Regulations, Materials License SNM-33 is hereby amended to allow a time extension for distributing the result reports of the April 1999, physicalinventory.

Accordingly, a temporary Safeguards License Condition SG-1.9 is being issued, effective immediately, and reads as follows:

SG-1.9 Notwithstanding the commitment, in Sections 2.3.2.6 and 5.2.1 of the FNMC Plan identified in Condition SG-1.1, to distribute the material status reports (DOE /NRC Forms 742 and 742C) within 30 days after the start of the physical inventory, the licensee shall have 15 additional days to fulfill the above stated commitment relative to the April 1999, physical inventory. This condition automatically expires on June 5,1999.

In addition, notwithstanding the above-mentioned commitment to distribute the -

physical inventory summary report (NRC Form 327) within 60 days after the start i of the physical inventory, the licensee shall have 15 additional days to fulfill the )

above stated commitment relative to the April 1999, physical inventory. This j condition automatically expires on July 5,1999.

The condition is approved pursuant to 10 CFR 70.34 and 75.35(b) based on our determination j that, in view of the specific circumstances, the additional time requested was justified and )

warranted. j
