NRC INSPECTION REPORT 070-00036/99001(DNMS) AND NOTICE i OF VIOLATION

Dear Dr. Kaiser:

On March 5,1999, the NRC completed a routine, announced inspection of operational safety, training, transportation safety, emergency preparedness, and maintenance at your Hematite -

facility. .The purpose of the inspection was to determine whether activities authorized by your license were conducted safely and in accordance with NRC requirements.

During the inspection, the conduct of activities observed at the Hematite facility was generally characterized by the effective implementation of applicable requirements. However, based on the results of the inspection, the NRC has deterrsed that a violation of NRC requirements

. occurred, The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation are described in detail in the enclosed report. This violation is of I concern because your staff did not implement a program, as required, for the testing, f calibration and inspection of a component defined by your Integrated Safety AssessmenUHazard Analysis as important to safety. The as-found condition of the safety component represented an increased risk for the failure of a cylinder within your cold trap system.

You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure compliance with <

regulatory requirements. l i

in accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter, its enclosures and your response will be placed in the NRC Public Document Room. .
