DECOMMISSIONING OF FORMER EVAPORATION PONDS (TAC No. L31142)

Dear Mr. Sharkey:

We have received your letter dated December 1,1998, clarifying the intent of section 4.2 of your " Hematite Evaporation Ponds Decommissioning Plan." This Plan was approved by License Amendment 18, dated January 26,1998.

Section 4.2 of the approved Plan states that the final status survey of the evaporation ponds will follow the methodology of NUREG/CR-5849, " Manual for Conducting Radiological Surveys in Support of License Termination." You indicated in your December 1,1998, letter that contamination at depth has been found in the ponds, which was not expected, and that you do not intend to follow section 4.2.4 of NUREG/CR-5849 on subsurface sampling. However, you indicated that the final status survey will include core sampling sufficient to statistically demonstrate compliance with the contaminant concentration goals.

NUREG/CR-5849 is a guidance document which provides one method to demonstrate '

compliance with specified contaminant concentration goals. Other methods exist, and the NRC staff does not object to your use of other sampling methodologies to demonstrate compliance with the contaminant concentration goals in subsurface soil.

Please contact Sean Soong of my staff at (301) 415-8155 if you have any questions on this matter. In addition, please inform us of your schedule for completing the final status survey so that the NRC may perform an inspection of your survey program and a confirmatory survey, if deemed necessary.
