NRC INSPECTION REPORT 070-00036/9E003(DNMS) AND NOTICE

Dear Dr. Kaiser:

On July 17,1998, the NRC completed a routine unannounced operational safety, radiation protection, emer0ency preparedness, and radioactive waste management inspection at your Hematite facility. The purpose of the inspection was to determine whether activities authorized 1 by your license were conducted safely and in accordance with NRC requirements.

During the inspection, your conduct of activities at the Hematite facility was generally characterized by the effective implementation of your operational safety, radiation protection, and radioactive waste handling and storage progums. In addition, the inspector noted your staff's response to an unusual event which occurred on July 13,1998, was effective. However, based on the results of the inspection, the NRC has determined that one violation of NRC requirements had occurred.

The violation is cited with two examples in the enclosed Notice of Violation (Notice) and the circumstances surrounding the violation and examples are described in detailin the enclosed report. The first example of the violation indicated a lack of rigor in the implementation of your standard operating procedures used for weekly and monthly safety system surveillance performed in the Oxide Building. The second example of the violation dealt with the improper storage of a hazardous chemical and exemplified a lack of completeness in thoroughly implementing corrective actions for significant safety issues identified by yr>ur staff during intemal audits. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. The NRC will use your response, in part, to determine whether further enforcement action is necessary to ensure comp'iance with regulatory requirements.
