COMBUSTION ENGINEERING'S RESPONSE TO UNRESOLVED ITEM 70-36/97-204-09

Dear Mr. Sharkey:

This acknowledges the receipt of your letter of March 27,1997, transmitting Combustion Engineering's response to our letter of February 18,1998. We have reviewed your response and discussed it with you by telephone on May 12,1998. As a result, we have determined that your response is consistent with 10 CFR 70.22(d). However, we note that there are three areas which the Nuclear Regulatory Commission will continue to follow as part of our routine inspection program: i (1) The supplemental information provided in response item No. 6 regarding the trouble shooting of the fire pump and the completion of the 1996 annual fire pump test during the month of September was not provided to the inspectors during the inspection. This additionalinformation will be reviewed as part of inspection followup item (IFI) 70-36/97-204-05.

(2) The evaluation of the existing sprinkler system performance capability provided in response item No. 7 did not address the most significant fire loading observed (i.e., pile storage) during the inspection. A!so, the evaluation did not reflect the original design basis or criteria for the existing sprinkler system in the Building 230 Warehouse, which would limit its performance capability. As a result, it appears that an inappropriate NFPA standard may have been applied in your evaluation. This will be included in followup for IFl 70-36/97-204-03 and IFl 70-36/97-204-06.

(3) Response itam No. 8, was based on the conclusion of your evaluation for response item No. 7, above. As a result, it did not fully address the most significant fire loading and the potential exposure for a fire involving pile storage that was adjacent to the filtrates. This will be included in the followup for IFl 70-36/97-204-07.
