4 ENGLQ1URL1 NOTICE OF VIOLATION I

Portland General Electric Company Docke' No.: 50 344 Trojan Nuclear Plant License No.- NPF-1 During an NRC inspection conducted on July 21-24, 1997, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUPEG-1600, the violation is listed below; i 10 CFR Part 20.1501(a)(2) states, in part, that each licensee shall make or cause to be made, surveys that are reasonable under the circumstances to evaluate (i) the extent of radiation levels; and (ii) concentrations or quantities of radioactive material; and (iii) the potential radiological hazards that could be present.

Contrary to the above, from ot.ptember 23,1996 to May 15,1997, the licensee '

failed to conduct surveys adequate to evaluate the quantity of radioactive material released from the radiologically controlled area. Specifically, Trojan site procedure RP 94 established an erroneous low count rate alarm setting for CM 11 radiation probes that defeated the low count rate alarm function of the instruments, and these instruments were used to perform surveys to evaluate the quantities of

.adioactive material present on items released from the site. This provided an opportunity for the instruments to be used in an inoperable or improperly responding condition without warning to the user (50 344/9703-01).

This is a Severity Level IV violation (Supplement IV).

Pursuant.to the provisions of 10 CFR 2.201, Portland General Electric Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20b55 with a copy to the Regional Administrator, Region IV,611 Ryan Plaza Drive, Suite 400, Arlington, Texas N011 withir. 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when iall umgilance will be achieved. Your response may reference or include previous cocketed correspondence, if the correspondence adequately addresses the required response. If an adequate reply is not received within the time specified in this Notice, an order _or a Demand for Information may be issued as to why the license should not be modified, suspended, or revoked, or why such other action as may be proper should not be taken, Where good cause is shown, consideration will be given to extending the response time.
