APPENDIX A NOTICE OF VIOLATION

, Portland General Electric Company Docket No. 50-344 I 121 S.W. Salmon Street License No. NPF-1 Portland, Oregon 97204 During an NRC inspection conducted February 28 - March 3, 1989, one violation

.of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1988), as modified by 53 Fed. Reg. 40019 (October 13, 1988), the violation is listed below:

A. 10'CFR 50.54(q) requires the. licensee to follow and maintain in effect emergency plans which meet the standards in 50.47(b) and the requirements in Appendix B of this part. 50.47(b)(4) and Section IV.B of Appendix E, 10 CFR 50 require that a standard emergency classification and action level scheme be in use by a nuclear facility licensee. Technical Specification 6.8.1 requires that written procedures for Radiological Emergency Plan implementation be established. implemented and maintained. 1 Section 2 of PGE's Radiological Emergency Response Plan (RERP) describes the emergency classification system. Emergency procedure EP-001 has been developed _to implement Section 2 of the RERP. Module 4, Step 5.1 of EP-001 identifies verified pressure boundary leakage as an Unusual Event.

Contrary to the above requirements, at 1835 on November 14, 1988, the plant staff determined that pressure boundary leakage existed, but did not declare an Unusual Event. {

No response to this violation is required in view of the corrective action initiated and documented in Inspection Report No. 50-344/89-04. l This is a Severity Level IV violation (Supplement VIII).
