Dear Mr. Eisenhut:

Pursuant to 10CFR50.54 and your letter (Reference 1), we are hereby sub-mitting 13 copies (10 to NRR and 3 to I & E Region IV) of the Fort St. Vrc.in Emergency Plan and implementing procedures, plus 13 copies of the State and local emergency plans.

As discussed in Reference 2, this is the third submittal of the Fort St.

Vrain Radiological Emergency Response Plan. The first submittal was in April,1980, just prior to the Nuclear Regulatory Commission open meeting concerning emergency preparedness. The second was in August,1980, which -

incorporated the comments received f.om the Nuclear Regulatory Commission open meeting. Since our August submittai, we have not to date received any correspondence from NRR concerning our August submittal. In an attempt to finalize the Radiological Emergency Response Plan, a meeting was held on December 10, 1980, with members of your staff to discuss their comments con-cerning the August submittal. Much to our surprise, our submittal had not been reviewed. In discussions with the Nuclear Regulatory Commission Project Manager, it was agreed that our August submittal would be construed as meeting the January 1,1981, commitment and that a revised plan would be submitted 30 days after receiving the Nuclear Regulatory Commission com-ments as stated in Reference 2. ,

Mr. Darriel G. Eisenhut February 27, 1981 While we recognized the requirement to submit our plan and the State and local plans, we did not feel it was appropriate to submit these plans with-out having the benefit of Nuclear Regulatory Commission cocunents. The State plan has been submitted to FEMA, and at the present time, we have no idea where this plan is in the review process. It should be noted that the State plan and the Fort St. Vrain plan have been developed to ensure consistency of operation. Comments that we may receive on our plan will necessarily reflect back into the State plan and may also reflect back into the FEMA review.

Based on the fact that the Nuclear Regulatory Commission comments on the Fort St. Vrain Radiological Emergency Response Plan do not appear to be forthcoming snd based on conversation with NRR, Special Projects Manager and Branch Chief, we are submitting these plans in their present form.

Please be aware that these plans, both the State and Fort St. Vrain plans, have been issued for interim use pending final review and approval.
