~ Public Service Company of Colorado-(PSC) originally submitted the FSV f

Decommissioning Financial Plan to the NRC in Reference 1,

in compliance with 10CFR50.33(k)(2). This Financial Plan was based on y

dismantlement and decontamination following a period of SAFSTOR.

.100FR50.82(c)(1) requires that funds needed to'~

complete decommissioning of a facility be set aside prior to the end of operations of that facility.

Due to the premature shutdown of FSV,

'PSC has not saccumulated the -full amount of funds required to accomplish' -FSV-decommissionin activities.

PSC submitted an exemption requtst (Reference 4,

which would require PSC to I

was the original intehded period of funds accumulation. PSC's Revised Decommissiening_ Financial Plan, which is based on SAFSTOR - is currently in effect, and funds will be accumulated in accordance with the provisions of this plan.

On June 26, 1990, PSC's Board of Directors _ decided to pursue, with other parties, the formation of a -new Independent Power Producer entity that would fund both the early dismantlement of FSV and the i

conversion of FSV to a natural gas powered electric generating i

faci ;ty.

.lf PSC is successful in forming the new Independent Power Producer entity, the entire amount required to fund.

early dismantlement could be available by 1992.

However, if and until -such time as negotiations for the. formation of the new Independent Power ProduceP entity are successfully completed, PSC will continue to fund SAFSTOR in accordance with" its Revised Decommissioning. Financial Plan.

PSC recognizes its' obligation to continue funding SAFSTOR, since this funding plan was selected by the Company as-the means to comply with 10CFR50.33(k)(2).
