Gentlemen:

Enclosed is the "NRC Staff's Motion for Clarification of Initial Decision with Regard to License Condition on Control Building Modifications" filed today in the referented proceeding. That motion seeks clarification as to the import of license condition 2.C.11 imposed by the Board in its Order accomoanying the initial decision.

The Licensing Board has determined that interim operation of Trojan, including operation, with conditions, concurrent with performance of the modification work, is acceptable.

In this regard, potential concerns, if any, raised by the lack of reference in license condition 2.C.11 to the supplemental docu-mentation and the Licensee's commitments therein (e.g. the Licensee's commit-ments to roughen adjacent structural elements to increase shear transfer (Licensee Exh. 33, Q.5, April 14, 1980 responses to Staff questions), the use of 2 inch diameter bolts, rather than 1 3/4 inch diameter bolts as stated in PGE-1020, to anchor new walls and the steel plates (Licensee Exh. 33, Q.6, April 14, 1980 responses to Staff questions), the installation of additional reinforcing steel in the R-line wall, relative to that set forth in PGE-1020, as comitted to by the Licensee in its March 17, 1980 response to Staff ques-tions (Licensee Exh. 25U)) which are the subject of the Staff's motion for

larification would only come into play, under the construction schedule in PGE-1020, after about three months from the authorization of construction.

During that time, action on the Staff's motion for clarification and any necessary expedited Staff appeal should have been taken.

In view of this and because it is desireable to implement the modifications and restore seismic margins to the Control Building expeditiously and without undue

1 delay, the Staff has not sought a stay of the initial decision pending clari-fication of the Licensing Board's intent with regard to license condition 2.C.11 and will issue the license amendment in accordance with the Board's Order accompanying the initial decision immediately.
