On Noveder 30, 1979, the Licensing Board entered a Modification of Order Pe=itting Interim Operneden of Trojan Nuclear Plant. 'Ihat Order had the effect of preventing the resu:ption of operaticn of the Trojan I:'xlear Fnr414ty (shut dcun since October 12, 1979, to repair steam generator leakage and to inspect piping supports in innccassible areas), pending further orders by the Board. That Order further provided as follcws:
"2. 3he Staff shall 4-dintely inform the Board, explicitly and clantly, stat utzresolved proble::s remain which might have a baring upon the seiede and other issues in this proraading.
This infmmHon shall be kept current upcn a regular basis.
- 3. 7he Licensee shall 4"nad4neely render a full written rgorr to the Board as to the status of all infor=ation requested of it by the Staff and not fully supplied to the Staff's enHefaction.

. h Staff, on Decadoer 7,1979, filed with the Board an explicit description of the tnresolved problems which might have a bearing upon the seidc and other issues in this proceeding, in the fo=n of Attachts. Attachaent 1 was entitled
" Affidavit of Kenneth S. Herring on the Unresolved Problems Regarding the Adequacy, Frcxn a Safety Standpoint, of the Proposed Control Building Modificadens to Brin 6 the Facility into Substantial Cmpliance With the License." Paragraph 4 of Attachnent 1 stated that the " adequacy of the margins against seis=ic failure, after the ucA4#4cnticns, of the Control Building Ca:elex itself (i.e., the level of wall structural integrity) has not been established. Resolution of this major u1 resolved problem requires the satisfactory resolution of the following iters",
and listed such itens as subparagraphs (a) thn: ugh (x). Paragraph 5 described another major tnresolved problen related to the adequacy of the stiffness assumed in certain analyses for the derivation of floor response spectra.
Attachnent 2 consisted of four affidavits setting forth the unresolved problems with regard to the effects of the proposed codification work itself on plant safety. h Staff deemed the unresolved proble:s describeci in Attachnents 1 and 2 as clearly matters within the jurisdiction of the Board. Attachnent 3 related to the so-called wall problen, which might be covered by a license condition (2.C(10).c) already i= posed for interim operation. The Staff antici-pated that it muld respond to paragraphs (4) and (5) of our Nove:bar 30 Order, suora, during the week of Deca ber 17, 1979.

Additional data or infor=ation was to be filed by D* 13,15 and 22. h Licensee also requested the Board (which we treat as a noticn) to issue a further order re:eving the prohibitien on rest =ptien of operatica, describing the adequacy of the infom*4nn turnished and the sericus need of the region for electricity at this time frcm the Trojan facility.
h Board believes that the public interest requires expeditious considera-tion and resolution of the issues implicit in the Novecber 30 Order, and addressed by the parti.es in their subsequent filings. Accordingly, a he d g will be held on these matters, as well as the establisinent of a schedula for the ccc:pletion of discovery, filing of notions, and m,u-x:ement of an ev4h4nry headng en Phase II issues. 'Ihis hearing will consider all affidavits, anlyses and repcs filed by the parties and may include the testineny of witnesses if deemed necessary to clarify, supplement or update previously filed infor=atien.
