ORDER FIXDU DATES FOR FILING CCtMNTIONS AND CwSE OF DISCOVERY (PHASE II)

(January 30, 1979)

On January 17, 1979, Licensee Portland General ElecMc Carpany (PGE) filed its " Report On Design Itdifications For the Trojan Control Euilding,"

prepared by Bechtel Power Corporation.

It was stated in the trans::ittal letter that such subnittal constituted the detailed description of the actions, design changes, and codifications, including supporting tests and analyses, and the request for any necessary license amendment, as centen-plated by paragraph (3) of the May 26, 1978 Order for Modification of License issued by NRC. Copies of this report were served by mail upon all parties to this proceed 1ng cn January 17, 1979.

Dur1ng the course of the evidentiary hearing on Phase I (interin operation), the Board anncunced that the Intervenors would be required to file their written contentions regarding the proposed =cdifications to the Control Building within 30 days from the filing of a detailed descriptien of such propcsed modifications. The period of discovery for Phase II issues regarding such proposed modificaticns of the Centrol Euildig was fixed at 60 days frco the date of filing (Tr. 2651-52, Dece ber 12, 1978).

In view of the service by = ail of the Report en Design Mcxiificaticns, the Intervenors are directed to file by Februarf 26, 1979 suoplements to 79020000N their petitiens to intervene which "c:ust include a list of the contentiens sich petitioner setas to have litigated in the matter, ard the bases for each contention set forth with reasonable specificity" (10 GR S2.714(b),

as a= ended).

The period for discoverf regarding the Centrol Buildira =odification issues (Phase II) shall extend frcm the date of filire of the detailed report (January 17, 1979), to and including March 2S,1979, ard shall be cocpleted by the latter date.

It is expected that the evidentiarf hearing on Phase II issues will cocmence shortly after the cm:pletion of discoverf.
