DIRECTOR'S DECISICN UNDER 10 CFR 2.2C5 By petition dated fiay 17, 1979, Nina Bell and Eugene Rosolie, on behalf of the Coalition for Safe Power (Coalition) requested that the Nuclear Regulatory Commission order shutdown of the Trojan Nuclear Power Plant. This petition was filed pursuant to 10 CFR 2.206 of the Commission's regulations.

The asserted bases for the request by the Coalition are that deficiencies exist with respect to fire protection and environmental qualification of electrical equipment.

The issues raised by the Coalition are generic in nature and directly related to those raised by the Union of Ccncerned Scientists in its November 1977 and May 1978 petitions. The Commission is now in the process of preparing a final Memorandum and Order in that proceeding.

The Coalition is correct in its statement that neither the NRC Staff Safety Evaluation Report dated October 7,1974 ncr its supplement dated November 21, 1975 addressed the environmental qualifications of electrical equipment.

Notwithstanding this onission, these 1087 034 7910080 [g/

s 7590-01 components were reviewed by the Staff and the Staff is not aware of the presence of any unqualified electrical equipnent. However, the pressure transmi,tters, while qualified for their safety trip function, have not been found qualified for long tern nonitoring. Accordingly, the licensee has provided an acceptable alternate means to obtain the long tern monitoring infomation in the fom of pressure and differential pressure transmitter. in the auxiliary building located outside containment.

Ir. addition, in response to IE Bulletin 79-01, PGE has reexamined the environmental qualification of all safety-related electrical equipment, and submitted this infomation in letters of June 12,1979 and June 15, 1979 to Mr. R. H. Engelken, Director, NRC Region V.

Based on the foregoing discussion, I have dete ned that no adequate basis exists at this tine for ordering shutdown of the Trojan Nuclear Power Plant. The request of the Coalition for Safe Power for immediate action is hereby denied.

Further consideration of the Coalition',s petition will be held in abeyance pending the Commission's decision in the UCS proceeding.*

  • This is in accordance with the Secretary of the Connission's July 31, 1979 nemorandum to the Director which stated:

"The Connission requests that you detemine if this petition contains any infomation indicating that immediate action is needed at the Trojan plant, as distinguished from generic actions which may result from the Comission's final detemination in the UCS proceeding. The petitioner should be infomed of the results of this inquiry.

If it is found that no imediate action is warranted, petitioner should be informed that further consideration of its petition will be held in abeyance pending the Connission's decision in the UCS proceeding."

20555 and the local public document roon for the Trojan Nuclear Power Plant located at the Colunbia County Courthouse, Law Library, Circuit Court Roon, St. Helent, Oregon 97051. A copy of this docunent will also be filed with the Secretary of the Connission fo its review in accordance with 10 CFP. 52.c.c(c) of the Connission's regulations.

In accordance with 10 CFR 52.206(c) of the Connissiof s Rules of Practice, this decision will constitute the final action of the Connission twenty (20) days after the date of issuance, unless the Connission on its own notion institutes the rev;eo Of t.'i: f cicion within that time.

Failure by the NRG Staff to compel Portl.:.d General Electric, the owner / operator of the plant, and on the part of the utility to remedy these deficiencies inja timely mannei or to indicate a willlingness to proceed expeditiously is the primary basis for bring!.ng this petition to the Commission rather than the Staff.

2 The Coalition for Safe Power is a non-profit citizens group that was founded in 1969 for the purpose of promoting appropriate tech-nologies and working to ensure the safety of nuclear power paints.

Its members and affiliated attorneys have representec' the CESP in several NRC proceedings regarding the Trojan Nuclear Plant as well as in rate hearings before theoregon Public Utility Commission. CFSP represents people throughout Oregon but primarily in the Portland area.

AUTHORITY 3.

The authority of the Comasion is not only appropriate, b st necessary, in this case.

The Office of Nuclear Reactor Regulation has known about at least one of the alleged deficiencies cince July 6,1978.
