PREHEARING CONFERENCE ORDER (March 20, 1980)

A prehearing conference was held in Phase II of this control building proceeding on March 11-12,-1980 in Portland, Oregon.

This final prehearing conference convened pursuant to notice duly published in the Federal Register on February 13,1980 (45 FR 9841).

All parties of record attended personally or by counsel, including the Licensee, the Bonneville Power Administration, the NRC Staff, the State of Oregon, and the Consolidated Intervenors.

The Staff reported that it had filed the Safety Evaluation Report (SER) with regard to the proposed modifications to the Trojan control building on February 14, 1980.

There were certain unresolved items which were the subj ect of supplemental information requested by the Staff of the Licensee at their meeting of March 7, 1980.

, t The Licensee filed a motion for summary disposition on February 7, 1980, concerning Contentions 3, 17, 20 and 22 filed by CFSP, now representing the Consolidated Intervenors.

The Staff filed responses on February 28, 1980.

After hearing arguments from the parties and counsel (Tr. 3475-3514), the Board granted the motion for summary disposition of Contention 3 (Tr. 3485), and denied summary disposition as to Contentions 17 (Tr. 3498) and Contention 20 (Tr.

3513).

The Licensee withdrew its motion for summary disposition of Contention 22 (Tr. 3514).

The remaining unresolved issues with regard to structural adequacy'of the modified complex, as originally laid out in Section 5 of the SER, were further identified, described and updated by the l

Staff (Tr. 3517-21).

l The Board through Dr. McCollom identified the following questions or issues as areas where evidence would be expected during the course of the evidentiary hearing:

The SER concerning the so-called " wall problem" was filed by the Staff on February 22, 1980.

Certain additional data or testing have been requested from the Licensee by the Staff, the results of which could raise additional questions or issues (Tr. 3538-48).

The question of interim operation of the Trojan facility during the period of time required to complete the proposed modifications to the control building, will also constitute an issue to be addressed by the parties in the evidentiary hearing (Tr. 3549-60).

By agreement among the parties and with the concurrence of the Board, the following schedule modifications shall be observed:

The parties identified the witnesses whom they expected to present at the evidentiary hearing to comm(nce on March 31, 1980 (Tr. 3574-3582).

The Staff agreed to have its security expert update his study and evaluation of the security aspects of the modification work, including some recent matters which the Consolidated Intervenors stated were of concern to them (Tr. 3588-9).

The Consolidated Intervenors withdrew Contention 4, and hence the Staf f's interrogatories concerning that contention need not be answered (Tr. 3615).

The time for response by Consolidated Intervenors to the remaining Staff interrogatories was extended to and including March 21, 1980.

With reference to the " wall problem", the Board decided that it would like'to have the results from the short-term tests and the conclusions flowing from them given to the Board, and included in the evidence at the evidentiary hearing (Tr. 3633).

In addition, there should be provided a description of what is proposed for the long-term tests, why it is proposed, and what is expected to come out of it (Tr. 3633-38.
