Supplemental Response to Inspection Report Number 50-345/89021 Gentlemen ,

Toledo Edison (TE) received Inspection Report Number 89021 (Log Number 1-2195) and provided its response to a Notice of Violation identified in the inspection report (Violation 89021-01) concerning pressure testing performed at Davis-Besse Nucl.est Power Station (DBNPS) in lieu of ASME Code required hydrostatic pressure testing. In the response, dated February 6, 1990 (Serial Number 1-908), Toledo Edison denied the alleged violation.

On July 31, 1990, members of the Toledo Edison staff met with the NRC staff at the Region III office to discuss issues relating to the alleged violation. .

Based upon these discussions, Toledo Edison hereby rescinds its denial and  ;

accepts the alleged violation.

On July 17, 1990, Toledo Edison subm!tted a request for relief from the requirements of Section XI of the ASME Code concerning hydrostatic testing i requirements (Serial Kaaber 1829). Relief from the requirements of IVA-5212 and IVA-5213 for certain systems where the IIT vas used during the first l l

! ten-year in-service inspection (ISI) interval was requested. Also, by letter J l dated July 17, 1990 (Serial Number 1823), Toledo Edison proposed to perform )

hydrostatic tests, in accordance with the ASME Code, on affected systems during the first period of the second ten-year ISI interval. The second ten-year ISI interval begins on September 21, 1990. Therefore, based on the above submittals, no further corrective actions are necessary.
