Dear Senator Humphrey:

Your letter of March 12, 1987 concerning an inquiry from the

" League of Towns" has been received.

The evidentiary hearings on the NHRERP which will begin on June 1, 1987 are to be held in the U. S. District Court at Concord, New Hampshire. This is the only Federal courthouse facility in the state. Past experiences indicate that when other facilities are used, the Board proceedings are at the discretion of others whose interest may conflict with the Board's.

There is no courtroom, Federal or state, on the seacoast which can accomodate the many attorneys and their large quantity of papers, exhibits and other materials used in the presentation of this case. As I pointed out to Congressman D' Amours in a letter dated April 20, 1983, the facility in which to litigate this licensing proceeding must afford the parties reasonable space and comfort to conduct their case without

! unnecessary physical handicaps, possess appropriate judicial decorum and be readily accessible to the public. The Federal District Court at Concord fulfills these essentials. Since it is the only Federal court-house in New Hampshire, it follows that its accessibility has already l been determined for the citizens of New Hampshire.

I will take this opportunity to add a coment. The " League of Towns" is composed of parties to this proceeding who have been admitted pursuant to the provisions of 10 CFR 2.715(c). These are towns and/or representatives who have actively participated in this proceeding for some time. It appears to be an organization seeking status as a separate entity when its parts are already parties.

I believe that the Board has made the best choice, if not indeed the only choice, for a location where the hearings can be conducted in a manner which will ensure that all parties and issues receive a fair hearing.
