Dear Senator Gore:

I am responding to your October 30, 1987 letter in which you

urge the Commission to deny a license for low-power testing at i

the Seabrook Station in New Hampshire until certain critical issues can be resolved.

Pursuant to the requirements of the Atomic Energy Act and the Commission's own rules,.the Commission's decision in a contested licensing proceeding is l

l made on the basis of the formal adjudicatory record.

Because the issue you raise is before the Commission in an adjudicatory proceeding, a copy of your letter has been served on all parties to that proceeding.

A copy has also been placed in the i

NRC's Public Document Room.

I am sure you will understand that I cannot respond more fully at this time to the substance of your concerns.

The Commission's decision in this matter will be rendered on the formal record of the Seabrook proceeding.

I can assure you, however, that in reaching this decision, the Commission's primary consideration will be protecting public health and safety.
