VNerses WRussell This is in response to your letter of May 25, 1988, in which you urge the Commission to delay the low power operation of the Seabrnnk nuclear power plant until emergency planning and financial qualification issues have been resolved. Pursuant to l requirements established by the Congress and regulations promulgated by the Commission, the Commission is unable to respond on the merits because the issues that you raise in your letter are currently in formal adjudication within the agency. Your letter l

has been served on the parties to the proceeding, and any action that the Commission takes will be on the formal record of the proceeding.

I As you are likely aware, the Licensing Board in the Seabrook proceeding has denied the petitian to waive the rules in order to consider financial qualifications in the context of the operating license hearing. That denial, for failure to make a prima facie showing, is on appeal. The Appeal Board will soon decide whether the petition was properly rejected or whether it should be forwarded to the Commission for decision. You will be served a copy of the Appeal Board's decision when it is issued, as well as any other forthcoming decision on issues related to authorizing a low power license.
