December 11, 1987 CHAIRMAN The Honorable Joseph R. Biden, Jr.
United States Senate Washington, D.C.
20510
Dear Senator Biden:
I am responding to your November 19, 1987 letter in which you urge the Commission not to grant a license for low-power testing at the Seabrook Station in New Hampshire at this time.
In your view such a license would lack utility because you believe emergency planning problems make it unlikely that the plant will operate at full power in the near future.
In addition, you raise as a significant problem the " declining financial health" of the lead applicant, Public Service Company of New Hampshire.
Pursuant to the requirements of the Atomic Energy Act and the Commission's own rules, the Commission's decisions in a contested licensing proceeding are made on the basis of the formal adjudicatory record. Because the matters you raise are at issue in a Coninission adjudicatory proceeding, a copy of your letter nas been served on all parties to that proceeding. A copy of your letter has also been placed in the NRC's Public Document Room.
I am sure you will understand that the Commission cannot respond more fully at this time to the substance of your concerns. The Conmission's decision in this matter will be rendered on the formal record of the Seabrook proceeding.
I can assure you, however, that in reaching this decision, the Commission's primary consideration will be protecting public health and safety.
Sincerely, W.
