Dear Congressman Mavroules:

I am responding to your November 20, 1987 letter in which you reaffirmed your opposition to the grant of a l_ow power license for operations up to 5%

capacity at Seabrook Station.

Pursuant to the requirements of the Atomic Energy Act and the Comission's own rules, the Comission's decisions in a contested licensing proceeding 'are made on the basis of the formal adjudicatory record. Because the subject you raise is at issue in a Comission adjudicatory proceeding, a copy of your letter has been served on all parties to that proceeding. A copy has also been placed in the NRC's Public Document Room.

I am sure you will understand that the Comission cannot respond more fully at this time to the substance of your concerns. The Comission's decision in this matter will be rendered on the formal record of the Seabrook

proceeding.

I can assure you, however, that in reaching this decision, the Comission's primary consideration will be protecting public health and safety.
