SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50 327/SS-35 AND 50-323/S3-35)

This refers to the special Nuclear Regulatory Commission (NRC) team inspection

conducted by Mr. M. Branch on July 11-15 and August 22-23, 1933. The inspection

included a review of conditions surrounding a recently identified concern

associated with the affect on end of life shutdown margin due to excessive

cooldowns following reactor trips. At the conclusion of the inspection, the

findings were initially discussed on July 14, 1933, with those members of

your staff identified in the enclosed inspection report and subsequently

re-discussed on August 23, 1933.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

'5e inspection findings indicate thit certain activities appear to violate NRC

requirements. The identified violation involved four examples of failure to

adequately identify and correct an operating deficiency that allowed the plant

to be operated outside the bases described in the FSAR and could have resulted

in the plant operating in an unanalyced condition at the end of core life.

The multiple example violation, which is described in paragraphs 4, 7.a. 7.b,

and 7.c of the enclosed recort is under consiceration for escalated enforce-

ment. Accordingly, a Notice of Violation addressing this violation is not being

issued at this time, and therefore no response to this violation is required.

However, pleased be advised that the characterication of the violation

described in this report may cnange as a result of f urther NRC review. You

will be advised by separate correspendence of the results of our deliberations

on this matter.

In accordance with Sec lon 2.790 of the NRC's "Rules of Practice," Part 2

Title 10, Code of Federai Regulations, a copy of this letter, it's enclosures, g

and any reply will be plau d in the NRC's Public Dccument Room.
