Gentlemen:

SUBJECT: NOTICE OF VIOLATION: EA 85-67

(INSPECTION REPORT NOS. 50-327/85-19 AND 50-328/85-19)

This refers to the special inspection conducted on May 8,1985, at the Sequoyah

Nuclear Plant to review the circumstances which led to an opening in a vital area

barrier being unprotected for a period of forty-one minutes. This event,

resulted from the inadequate communications between security personnel at the

compensatory post. The violation was discovered by licensee security personnel.

At the time of the violation, Unit I was in mode five and Unit 2 was in mode

four. The Nuclear Regulatory Commission's (NRC) concerns were discussed by

Mr. John A. Olshinski, Deputy Regional Administrator, and Mr. James P. Darling,

Director, Office of Nuclear Power, Tennessee Valley Authority (TVA), in an

Enforcement Conference held at NRC Region II, Atlanta, Georgia, on May 15, 1985.

In accordance with the " General Statement of Policy and Procedure for NRC

Enforcement Actions," 10 CFR Part 2, Appendix C (1985), the violation described

in the enclosed Notice has been classified as a Severity Level III violation.

Normally a civil penalty is considered for a Severity Level III violation.

However, after consultation with the Director, Office of Inspection and

Enforcement, I have decided that a civil penalty will not be proposed in this

case because of your prompt identification and reporting of the violation and the

unusually prompt and extensive corrective action.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response. In your response,

you should document the specific actions taken and any additional actions you

plan to prevent recurrence. After reviewing your response to this Notice of

Violation, including your proposed corrective actions, the NRC will determine

whether further NRC enforcement action is necessary to ensure compliance with

NRC regulatory requirements.

In accordance with 10 CFR 2.790(d) and 10 CFR 73.21, safeguards activities and

security measures are exempt from public disclosure; therefore, the enclosures

l to this letter, with the exception of the report cover page which presents a

l nonexempt summary, will not be placed in NRC's Public Document Room.
