Dear Messrs. Gallo and Guild:

This letter confirms the agreement reached with you on Thursday, January 30, 1986. In a telephone conference on that date, I advised you that I had

,iust learned that Region III NRC Inspector Robert D. Schulz had resigned his position with the Nuclear Regulatory Commission effective February 11, 1986. I informed you that after Mr. Schulz leaves the agency, the NRC Staff would have no authority to ensure his participation in the above-captioned proceeding. In view of this consideration, I suggested that the parties complete Mr. Schulz's deposition prior to his departure.

I indicated that the Staff could make Mr. Schulz available for deposition on Thursday and Friday, February 6 and 7, 1986.

Mr. Gallo indicated that these dates presented a schedule conflict and suggested Tuesday, February 4, 1986 as an alternative. That date, how-ever, presented Mr. Guild with a schedule conflict. It was then suggested that we attempt to schedule the deposition for Monday, February 10, 1986.

I indicated that I would notify you after I learned whether Mr. Schulz would be available on that date. Later that afternoon I spoke with l Mr. Schulz and he informed me that he would. I then advised you of that fact.

. It is agreed that Mr. Schulz's deposition will be scheduled for Morday, February 10,1986, at 10:00 a.m. at the Chicago offices of Isham, Lincoln & Beale. Please note again that the scheduled deposition date is the last date upon which Mr. Schulz will be made available by the Staff.
