The information identified in Enclosures 2 and 3 of the attached letter dated October 6,1986, is a portion of the Seabrook Plan for Massachusetts Cceunities provided to the NRC by Public Service of New Hampshire (PSNH), under a claim that it is exempt from mandatory public disclosure pursuant to 10 CFR 2.790 of the Comission's regulations. Our agency procedures for 2.790 submittals require that we make a technical and legal determination on that application as soon as possible. In the interim, however, we treat cil such submitted material and information as prcprietary and non-publir. At the same time, however, we understand your need to read and incorporate this submittal in your ongoing review and evaluation of the Seabrook offsite plans. Thus, we are providing this information to you in confidence and ask that you give it proprietary treatment and non-public distribution until our 2.790 process is completed.

We will naturally give you the results of our determination when it is made and you can then adjust your holding accordingly.

It is our understanding that copies of Eaciosures 2 and 3 have already been provided to the Regional Assistance Comittee Chairrian by PShH. It is also our understanding that PSNH will submit the information that was requested on the status of the arrangements for access to the acoustic locations at a later date. This information will be forwarded to you when we receive it.

Thank you in advance for your cooperation and assistance in this matter. We only ask additionally that you imediately notify u, if you receive a Freedom of Infomation Act request that "captures" our shard information.
