OF JULY 30, 2013, MEETING WITH DUKE ENERGY REGARDING A CHANGE TO THE EMERGENCY RESPONSE FACILITY ACTIVATION TIMELINESS AND CRITERIA (TAC NO. MF2449)
On July 30, 2013, the Nuclear Regulatory Commission (NRC) staff conducted a Category 1 public meeting via teleconference call with Duke Energy Inc., which is representing Carolina Power & Light Company, the licensee for Shearon Harris Nuclear Power Plant, Unit 1 (Harris);
at NRC Headquarters, Three White Flint North, 1160'1 Landsdown Street, Rockville, Maryland.
The purpose of the meeting was for Duke Energy to discuss its change to the emergency response facility activation times and criteria. The meeting notice was publicly available on the NRC's website and is documented in the NRC's Agencywide Documents Access and Management System (ADAMS) at Accession No. ML13198A087. The licensee also provided the meeting presentation slides (ADAMS Accession No. ML13218B337). The list of participants of the meeting is provided in the enclosure to this summary.
During the conference call, the licensee described the background and the description of the two proposed changes. The first change proposes to align the emergency response facility activation times in the emergency plan implementing procedures with the staff augmentation times. The licensee proposes to revise all implementing procedures to remove the lower 60-minute limit facility activation time for the Emergency Operations Facility, the Technical Support Center and the Operations Support Center, without changing the maximum 75-minute timeframe personnel have to respond to their respective facilities.
The second change proposes to revise the emergency plan and the emergency plan implementing procedures to provide clear criteria for activating emergency response facilities.
The licensee indicated that the emergency plan implementing procedures do not consistently clarify whether activation is declared prior to or after emergency personnel turnover.
During the conference call, the NRC staff indicated that Title 10 of the Code of Federal Regulations (10 CFR) Section 50.54(q) "Emergency plans," specifies the requirements for emergency plant changes and asked a few clarification questions. The objectives for 10 CFR 50.54(q) are to ensure that licensees (1) follow and maintain the effectiveness of their approved emergency plans, (2) evaluate proposed changes to these plans for their impact on the effectiveness of the plans, and (3) obtain prior NRC approval for changes that would reduce the effectiveness of the plans. The NRC staff also indicated to the licensee that Regulatory Guide 1.219 "Guidance on Making Changes to Emergency Plans for Nuclear Power Reactors" provides methods that the NRC staff considers acceptable for use in implementing specific parts of the agency's regulations related to emergency plan changes. The licensee discussed that the two proposed changes eliminate ambiguity in the emergency plan requirements and that the changes do not reduce the effectiveness of the emergency plan.
