SUMMARY

OF NOVEMBER 29, 2021, MEETING WITH DUKE ENERGY PROGRESS, LLC AND DUKE ENERGY CAROLINAS, LLC TO DISCUSS A PLANNED LICENSE AMENDMENT REQUEST TO RELOCATE THE DUKE ENERGY COMMON EMERGENCY OPERATIONS FACILITY (EPID L-2021-LRM-0112)

On November 29, 2021, an Observation Public Meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Duke Energy Progress, LLC and Duke Energy Carolinas, LLC (the licensee) via teleconference. The purpose of the meeting was to discuss a planned license amendment request (LAR) to discuss relocation of the Duke Energy common emergency operations facility (EOF) from its current location to a new location approximately 9 miles away (both locations are within the city of Charlotte, North Carolina). The meeting notice and agenda dated November 2, 2021, are available at Agencywide Documents Access and Management System (ADAMS) Accession No. ML21333A145. A list of attendees is provided as an enclosure.

The licensee presented information (ADAMS Accession No. ML21322A326) regarding the description of the planned change, applicable regulatory requirements and guidance, the licensees evaluation approach, precedent, and schedule. With regards to the planned change, the licensee stated that the relocation would not result in a reduction in effectiveness, and there was acknowledgement that an NRC Commission vote would be required as part of the approval since the EOF would be located greater than 25 miles away from any nuclear site. The licensee discussed that for the Catawba Nuclear Station, Units 1 and 2 (Catawba), and McGuire Nuclear Station, Units 1 and 2, facilities, the current EOF would be credited as the near-site location for NRC and other offsite responders, and the proposed new EOF would be credited as the alternate emergency response facilities (ERF) for licensee responders. Additionally, the licensee stated that for the Brunswick Steam Electric Plant, Units 1 and 2, Shearon Harris Nuclear Power Plant, Unit 1 (Shearon Harris), Oconee Nuclear Station, Units 1 and 2, and Robinson Steam Electric Plant, Unit 2, facilities, the near-site locations and alternate ERFs would remain unchanged as part of this planned LAR.

With respect to the evaluation approach for the new EOF location, the licensee referenced application of NUREG-0696, Functional Criteria for Emergency Response Facilities, as-modified by NSIR/DPR-ISG-01, Interim Staff Guidance on Emergency Planning for Nuclear Power Plants, as the primary evaluation criteria documents, and that facility walk-through and

familiarization drills would be conducted prior to implementation of the proposed change.

Further, the licensee stated that planning was in progress for a two-site demonstration drill on April 27, 2022 with the Catawba and Harris facilities utilizing the new EOF. Finally, the licensee noted precedent for the proposed change by discussing two prior amendments associated with EOF relocations.

With respect to the schedule for the LAR, the licensee anticipated submittal of the LAR on December 31, 2021, with a requested approval within 1 year of acceptance.

The NRC staff queried the inclusion of William States Lee III, Units 1 and 2 (Lee), within the presentation material. The licensee responded that this proposed facility was included because the NRC-issued and licensee-maintained combined operating licenses for Lee refer to the current EOF. However, since this facility would not be expected to require an EOF within the implementation period of the planned LAR, this facility was only included for awareness only.

No comments or public meeting feedback were received. No regulatory decisions were made at this meeting.
