SUMMARY

RELATED TO THE REVIEW OF LICENSE AMENDMENT REQUEST TO REVISE THE 10 CFR 50.69, RISK-INFORMED CATEGORIZATION AND TREATMENT OF STRUCTURES, SYSTEMS AND COMPONENTS FOR NUCLEAR POWER REACTORS, CATEGORIZATION PROCESS TO REFLECT AN ALTERNATIVE SEISMIC APPROACH (EPID L-2021-LLA-0003)

Dear Ms. Maza:

By application dated January 14, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21014A092), Duke Energy Progress, LLC (the licensee) submitted a license amendment request (LAR) for Shearon Harris Nuclear Power Plant Unit 1 (Harris). The proposed LAR would revise the license condition associated with the adoption of Title 10 of the Code of Federal Regulations (10 CFR), Section 50.69, Risk-informed Categorization and Treatment of Structures, Systems and Components for Nuclear Power Reactors to reflect an alternative approach to the one provided in Nuclear Energy Institutes (NEI) 00-04, 10 CFR 50.69 SSC Categorization Guideline, Revision 0 (ADAMS Accession No. ML052910035), for evaluating the impact of the seismic hazard in the 10 CFR 50.69 categorization process.

To enhance the review of the licensees request, the U.S. Nuclear Regulatory Commission (NRC) staff conducted a regulatory audit on May 11, 2021. A summary of the regulatory audit is enclosed. The NRC staff did not identify any significant issues during the audit. At the conclusion of the audit, the licensee informed the NRC that a supplement was to be sent to the NRC addressing the proposed audit questions, found in Section 6.0 of the audit plan dated April 26, 2021 (ADAMS Accession No. ML21099A274). The licensee provided a supplement dated June 8, 2021 (ADAMS Accession No. ML21159A046) addressing the proposed audit questions. The NRC staff has reviewed the supplement and determined that no additional information is required.

1.0 BACKGROUND

A regulatory audit is an activity undertaken by the U.S. Nuclear Regulatory Commission (NRC) staff to examine and evaluate licensee information with the intent to gain an understanding of, verify, or identify information that will require docketing to support the basis of a licensing or regulatory decision.

By application dated January 14, 2021 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML21014A092), Duke Energy Progress, LLC (the licensee, Duke Energy) submitted a license amendment request (LAR) for Shearon Harris Nuclear Power Plant Unit 1 (Harris). The proposed LAR would revise the license condition associated with the adoption of Title 10 of the Code of Federal Regulations (10 CFR), Section 50.69, Risk-informed Categorization and Treatment of Structures, Systems and Components for Nuclear Power Reactors to reflect an alternative approach to the one provided in Nuclear Energy Institutes (NEI) 00-04, 10 CFR 50.69 SSC Categorization Guideline, Revision 0 (ADAMS Accession No. ML052910035), for evaluating the impact of the seismic hazard in the 10 CFR 50.69 categorization process.

The NRC staff performed a preliminary review of the LAR and determined that a regulatory audit would assist in the timely completion of the review. The NRC staff conducted a regulatory audit that included a discussion with the licensee on May 11, 2021. The audit plan was provided to the licensee on April 26, 2021 (ADAMS Accession No. ML21099A274).

2.0 AUDIT ACTIVITIES AND OBSERVATIONS The remote audit was conducted using teleconferencing capabilities. The purpose of the audit was to (1) confirm internal licensee information that supports statements made in the LAR, and

(2) determine whether the information included in the documents is necessary to be submitted to support a safety conclusion.

Discussions on the topics identified in the attachment of the audit plan were held with the licensee during an audit call conducted on May 11, 2021. The NRC staff assessed the information provided during the audit to determine whether additional information would be needed to support a regulatory finding, and therefore, would need to be submitted for review.

The licensee provided a supplement dated June 8, 2021 (ADAMS Accession No. ML21159A046) addressing the proposed audit questions.
