SUMMARY
OF AUGUST 7, 2019, MEETING WITH DUKE ENERGY PROGRESS, LLC AND DUKE ENERGY CAROLINAS, LLC TO DISCUSS A PROPOSED LICENSE AMENDMENT REQUEST FOR A COMMON EMERGENCY PLAN On August 7, 2019, a public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Duke Energy Progress, LLC and Duke Energy Carolinas, LLC (the licensee) at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the proposed license amendment request for a common emergency plan for Catawba Nuclear Station, Unit Nos. 1 and 2; McGuire Nuclear Station, Unit Nos. 1 and 2; Oconee Nuclear Station, Unit Nos. 1, 2, and 3; Brunswick Steam Electric Plant, Unit Nos. 1 and 2; Shearon Harris Nuclear Power Plant, Unit No. 1; and H. B. Robinson Steam Electric Plant, Unit No. 2. The meeting notice and agenda, dated July 25, 2019, are available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML19206A038. A list of attendees is enclosed.
The licensee presented informational slides at the meeting (ADAMS Accession No. ML19214A056). During the meeting, the licensee described its plan to revise all the above facilities emergency plans to merge them into one common plan (with site-specific annexes) that is consistent with draft NUREG-0654/FEMA-REP-1, Revision 2, Criteria for Preparation and Evaluation of Radiological Emergency Response Plans and Preparedness in Support of Nuclear Power Plants (NUREG-0654) (ADAMS Accession No. ML14163A605), as updated by the alternative guidance in the NRC letter to the Nuclear Energy Institute dated June 12, 2018 (ADAMS Accession No. ML18022A352). The licensee identified potential reductions in effectiveness with respect to the current emergency plan or NUREG-0654, Revision 2, and the planned justification to show continued adequate emergency preparedness. The licensee also identified the planned format and content of the license amendment request, comparable precedents, and the planned submittal schedule.
The NRC staff and the licensee discussed the above topics. The staff stated that since draft Revision 2 to NUREG-0654 has not yet been formally approved by the NRC, the licensees use of the draft revision would be treated as alternate guidance. The NRC staff will review the submittal against the approved Revision 1 to NUREG-0654 (ADAMS Accession No. ML040420012) and evaluate any differences. Due to the complexity of the submittal, the NRC staff emphasized the need for periodic public meetings/calls to discuss potential issues and staff questions to minimize potential requests for information and facilitate the staffs review.
The NRC staff discussed how the review of proposed changes to licensee emergency response organization on-shift and augmented staff would be conducted and reviewed lessons learned from recent reviews using the alternate guidance cited above. The NRC staff also stated that the licensee should ensure sufficient information supporting respective changes - for example, the basis for an existing plan commitment and why it may no longer be valid. Finally, the staff requested that the licensee provide an evaluation of potential changes on offsite response organizations along with letters of concurrence from these organizations.
In regard to the licensees request for a 1-year review, the NRC staff indicated that they would evaluate this request as part of the acceptance review, due to the complexity of the submittal, and a decision would be made based on discussions with NRC management.
Several members of the public called into the meeting, but none offered comments. No regulatory decisions or commitments were made at the meeting. No public meeting feedback forms were received.
