OF SEPTEMBER 29, 2016, MEETING WITH DUKE ENERGY PROGRESS, LLC TO DISCUSS PROPOSED LICENSE AMENDMENT REQUEST FOR SHEARON HARRIS NUCLEAR POWER PLANT, UNIT 1, REGARDING BOILING-WATER REACTOR STORAGE RACK INSERTS AND SPENT FUEL POOL CRITICALITY ANALYSIS (CAC NO. MF8327)

On September 29, 2016, a Category 1 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) staff and representatives of Duke Energy Progress, LLC (the licensee), at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to discuss the proposed license amendment request (LAR) regarding boiling-water reactor (BWR) storage rack inserts and spent fuel pool (SFP) criticality analysis for the Shearon Harris Nuclear Power Plant, Unit 1 (Harris). The meeting notice and agenda, dated September 9, 2016, are available in the Agencywide Documents Access and Management System (ADAMS) under Accession No. ML16253A110.

The licensee presented informational slides at the meeting (ADAMS Accession No. ML16267A029).

During the meeting, the licensee discussed the unique configuration of the Harris SFP in that Brunswick Steam Electric Plant BWR fuel assemblies are stored at Harris, which is a pressurized-water reactor (PWR) site. The SFPs at Harris have BWR and PWR racks. The licensee plans to remove credit for Boraflex in the BWR fuel storage racks. The licensee explained its proposed insert design, and the different accident scenarios it will model in its application. The design the licensee is proposing for the Harris SFP is a new design that is unprecedented. The licensee provided a list of the Technical Specifications that will be affected by the proposed LAR. The licensee plans to install the new inserts under the Title 10 of the Code of Federal Regulations (10 CFR) Section 50.59, "Changes, tests, and experiments," process. The NRC staff asked whether the new inserts would have any impact on the analysis of record and the licensee responded that the analysis of record would not be impacted by installation of the inserts. Currently, the Harris SFP is operable but degraded due to the Boraflex degradation. The licensee plans to request a 12-month review schedule and plans to submit the proposed LAR during the first quarter of 2017. The NRC staff informed the licensee that SFP criticality LARs currently in-house under review are taking over 12 months to be completed. Due to the unprecedented design and the uniqueness of the proposed LAR at Harris, the NRC staff informed the licensee that this review will likely be considered a complex licensing action and the licensee should plan for a review schedule that will exceed 12 months. The NRC staff will provide an estimate of the review schedule after completing an acceptance review of the licensee's submittal.
