OF JULY 9, 2013, MEETING WITH DUKE ENERGY REGARDING A NONCONSERVATIVE TECHNICAL SPECIFICATION LOSS OF OFFSITE POWER VOLTAGE SETPOINT LICENSE AMENDMENT REQUEST (TAC NO. MF1498)

On July 9, 2013, the Nuclear Regulatory Commission (NRC) staff conducted a Category 1 public meeting via teleconference call with Duke Energy Inc., which is representing Carolina Power & Light Company, the licensee for Shearon Harris Nuclear Power Plant, Unit 1 (Harris);

at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was for Duke Energy to discuss its proposed license amendment request (LAR) regarding a nonconservative Technical Specification (TS) for loss of offsite power (LOOP) setpoint at Harris. The meeting notice was publicly available on the NRC's website and is documented in the NRC's Agencywide Documents Access and Management System (ADAMS) at Accession No. ML13162A296. The list of participants of the meeting is provided in the enclosure to this summary.

During the conference call, the licensee described the background, the description of the change and the basis for the proposed LAR. In terms of background, the licensee indicated that as a result of a Component Design Basis Inspection (CDBI) finding, there was reasonable doubt as to whether the permanently connected safety-related loads would remain available to respond to a LOOP following a nonaccident degraded voltage condition, for the duration of the time delay chosen for the degraded voltage relay. The CDBI finding resulted in nonconservative TSs for Harris due to not fully established analytical limits and the bases for allowable values and trip septoints over-used engineering judgment and industry-standards practices.

The licensee proposed change consists of revising Unit 9.a "Loss of Offsite Power 6.9 kV Emergency Bus Undervoltage-Primary" in the TS Table 3.3-4 "Engineered Safety Features Actuation System (ESFAS) Instrumentation Trip Setpoints." The licensee provided a markup of the TS in the meeting presentation slides (ADAMS Accession No. ML13204A256). The licensee's voltage point setpoints change basis consists on lowering the analytical limit for voltage established based upon procurement specifications and voltage drop calculations, and in calculating the minimum allowable value and trip setpoint using the standard setpoint methodology.

During the conference call, the NRC staff discussed its overall expectation of the LAR, the scheduling, and asked a few clarification questions. The NRC staff indicated to the licensee that the proposed LAR should include a description of the methodology used to calculate the voltage setpoins, and that the accident analysis meets the criteria of Chapter 15 "Accident Analysis" of the Updated Final Safety Analysis Report.
