Gentlemen:

The enclosed application requests that the Davis-Besse Nuclear Power Station (DBNPS), Unit Number 1 Operating License, Appendix A, Technical Specifications (TS).be revised to reflect the changes attached. The proposed change involves Section 3/4.0 (Limiting. Conditions for Operations and Surveillance Requirements - Applicability), Surveillance Requirement (SR) 4.0.2.

Surveillance Requirement 4.0.2 includes a provision that allows surveillance intervals to be extended by 25 percent of the specified time interval. This.

provides flexibility for scheduling the performance of surveillance and to permit consideration of plant operating conditions that may not be suitable for conducting of a surveillance at its specified time interval. Such conditions include transient plant operation or safety systems that may be out-of-service due to maintenance or other ongoing surveillance activities.

7 Specification 4.0.2 further limits the 25 percent allowance for extending surveillance intervals by requiring that the combined time interval for any three consecutive surveillance not exceed 3.25 times the specified surveillance interval. This application proposes the removal of the 3.25 limit required by SR 4.0.2b.

The DBNPS sixth refueling outage is presently scheduled to commence about

. February 1, 1990. Toledo Edison's review of scheduled surveillance requirements indicates that the 1.25. limit (i.e., 4.0.2a limit) vill not be reached before February 1, 1990, for a surveillance which requires a plant shutdown to be performed. However, the 3.25 limit (i.e., 4.0.2b limit) vill

-Page 2 The NuElear Regulatory Commission (NRC) recently issued similar. amendments to Commonwealth Edison Company for Units 1 and 2 of the LaSalle County Station on July 19, 1989. LIn addition, Toledo Edison has been informed that a NRC Generic Letter will be issued in the near future to inform licensees that this change vill be approved for all plants.

Toledo Edison ~ requests that the amendment be issued for DBNPS by October 31, 1989, for implementation by November 13, 1989, to prevent an unnecessary shutdown of DBNPS Unit 1. This amendment request supersedes Toledo Edison's previous submittal dated October 31, 1988, (Serial Number 1588) which applied only to 18-month surveillance under SR 4.0.2b.
