y ENCLOSURE 1 NOTICE-OF VIOLATION Virginia Electric and Power Company Docket Nos. 50-338, 50-339 North Anna Units l'and 2 License Nos. NPF-4, NPF-7 During the Nuclear Regulatory Commission (NRC) inspection conducted on April 18 - May 31,1989,- violations of NRC requirements were identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, 53 Fed. Reg. 40019.

(October 13, 1988) (Enforcement Policy), the violations are listed below:

A. Technical Specification 6.5.2.7 states in part that the following subjects shall be reviewed by the Independent / Operational Event Review Group:

' Written safety evaluations of changes in procedures as described in the Safety Analysis Report and tests or experiments r.ot described in-the Safety Analysis Report which are completed without prior NRC approval under the provisions of.10 CFR 50.59(a)(1).

This review'is to verify that such changes, tests or ' experiments did not' involve a change in the technical specifications or an unreviewed safety question as defined in 10 CFR.50.59(a)(2) and is accomplished by review of minutes of the ' Station Nuclear Safety and Operating Committee and the design change program.

Violations, REPORTABLE EVENTS and Special Reports such as:

1. Violations of applicable codes, regulations, orders, Technical Specifications, license requirements or internal procedures or i

j instructions having safety significance;

2. Significant operating abnormalities or deviations from normal or j expected performance or station safety-related structures, systems, or components; and '

3. ALL REPORTABLE EVENTS submitted in accordance with Section 50.73 to 10 CF.R Part 50 and Special Reports required by Specification-6.9.2.

Review of events covered under this paragraph shall include the results of any investigations made and recommendations resulting from such investigations to prevent or reduce the probability of recurrence of the event.

Notice of Violation 2 Contrary to the above, on May 25, 1989 the inspector determined, based on a review of the independent review program and discussions with Llicensee personnel, that the licensee's independent review group was i

' not performing 'all of the document reviews. required by Technical Specification.

This is a Severity IV Violation (Supplement I) and applies to both units.

B. Technical Specification 6.8.1.L requires written procedures be established, implemented, and maintained covering refueling operations.

Contrary to the above, on April 27, 1989 the licensee attempted ' to place a new fuel assembly into a spent fuel pool rack location already containing a spent fuel assembly. This occurred due to an inadequate ,

procedure 1-0P-4.2, Receipt and Storage of New Fuel. The procedure was

' inadequate in that the Fuel Handling Data Sheet supplied by the licensee's corporate Fuel Audit and Inspection group did not accurately reflect the actual locations of several~ spent fuel assemblies.

This 'is a Severity Level V (Supplement I) Violation and applies to both units.

C. Technical Specification 6.8.1.a requires written procedures be established, implemented, and maintained covering procedures. recommended-in Appendix A of Regulatory Guide 1.33, Revision 2, February 1978.

Section 9 of Regulatory Guide 1.33 requires procedures for performing maintenance.

1. Contrary to the above, on May 20, 1989 the licensee commenced replacement of an unisolated charging system filter element 2-CH-FL-2 instead of the isolated filter element 2-CH-FL-5 for which the replacement was intended. This occurred due to the licensee's failure to follow maintenance procedure MMP-C-FL-5, Radiation Work Permit 89-2256 and work order 089584 which resulted in the work being commenced on the wrong filter element.
1. Contrary to the above, the Instrument Calibration Procedure for steam generator B Feed Flow Protection Channel IV, ICP-FW-2-F-2486, was inadequate in that the procedure's initial conditions stated that there were no coincidence requirements during modes 3, 4, 5, or 6.

This caused an unexpected automatic reactor protection system reactor trip signal to be generated during procedure performance on May 2, 1989.

This is a Severity Level V (Supplement I) violation and applies to both units.

Pursuant to the provisions of 10 CFR 2.201, Virginia Electric and Power Company is hereby required to submit a written statement or explanation to  !

the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region II, and a copy l

Notice of Violation 3 to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice. This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time. If an adequate reply is not received within the time specific in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revcKed or why such other action as may be proper should not-be taken.
