SUBJECT: NOTICE OF VIOLATION

(NRC INSPECTION REPORT NOS. 50-338/89-14 AND 50-339/89-14)

This refers to the Nuclear Regulatory Commission (NRC) inspection conducted by i

J. L. Caldwell on April 18 - May 31, 1989. The inspection included a review of

activities authorized for your North Anna Power Station. At the cont.iusion of

the inspecticn, the findings were discussed with those members of your staff

identified in the enclosed inspection report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of selective examinations of procedures

and representative records, interviews with personnel, and observation of

activities in progress.

The inspection findings indicate that certain activities appeared to violate

NRC requirements. The violations, references to pertinent requirements, and

elements to be included in your response are described in the enclosed Notice

of Violation. As discussed in paragraph 14 of the enclosed inspection report,

we are also concerned about management's ability to ensure that future 10 depen-

dent review activities will meet both letter and intent of technical spec 4fic.-

tions. As such, in addition to your response to the specific matters ide-i "ied

in the enclosed Notice, we request that you provide a description of the ineans

by which you will assure that the independent review function will be supported

by management in the future.

The enclosed inspection report also describes an additional example of an

apparent violation, which is under consideration for escalated enforcement

action. The apparent violation was discussed at an Enforcement Conference on

May 24, 1989.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2,

Title 10, Code of Federal Regulations, a copy of this letter and its enclosures

will be placed in the NRC Public Document Room.
