PROPOSED IMPOSITION OF CIVIL PENALTY - $15,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $15,000 will be issued on or about January 7, 1994 to the Virginia Electric and Power Company. This action is based on two previous similar Severity Level IV violations issued on December 7, 1990, and May 15, 1992. The violation involves the licensee's failure l to demonstrate operability of the Unit 2 ECCS subsystems by conducting adequate flow tests of the centrifugal charging pumps to verify flow characteristics. A civil penalty is being issued for the repetitive nature of the violation which is based on ineffective corrective actions and insufficient root cause analysis' for the previous similar violatio'ns. The base civil penalty for a Severity Level IV violation is $15,000. Civil penalties for severity Level IV violations are normally proposed at the base value without assessing civil penalty adjustment factors.

It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:

Mailing of Notice January 7, 1994 Telephone Notification of Licensee January 7, 1994 The State of Virginia will be notified.

The licensee has thirty days from the date of the Notice in which to respond. Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
