Dear Mr. Smith:

Your letter of February 27, 1987 has been received. Since members of the League _of Towns are either parties to the offsite emergency hearings presently before the Board and/or represented by members of the League's Board of Director, it is appropriate that I respond directly to you.

I frankly have no idea what "1982 ruling" the parties to this proceeding have reference to in their letter to the New Hampshire Congressional Delegation of January 22, 1987. I was Chairperson of'the Board in four prehearing conferences on May 6-7, 1982 and July 15-16, 1982 at Portsmouth, New Hampshire. The public record of these proceed-ings may be examined at the Exeter Public Library, where copies of the transcript are deposited, if any of the parties do not have copies of the transcript.

The on-site contentions before the Board chaired by Judge Sheldon Wolfe will be the subjects of the decision of that Board within the.next ,

few days. I have spoken with Judge Wolfe'.4 Board and have been advised that there are no security issues to be decided nor were there any such matters placed in issue by the parties and accepted for litigation by the Board.

The schedule for filing of contentions based on the New Hampshire Radiological Emergency Response Plan - Revision 2 required that con-i tentions based on the Revision 2 be filed by December 1,1036. The l present posture of these issues is that the parties have filed discovery

requests. Hearings in the U. S. District Court at Concord, New Hampshire will begin on June 1,1987. In brief, the time for filing contentions either in regard to the on-site issues or offsite issues has i long ago expired. However, nontimely filing may be made in accordance withtheprovisionsof10CFR2.714(a)(1). I believe that each of the towns comprising the League is well aware of these matters since they have been actively engaged in this proceeding for some time. i I
