JAN 1 I 1993 Docket No._50-416 License No'. NPF 29 Entergy Operations, In ATTN: Mr. W. T. Cottle, Vice President Nuclear Operations - Grand Gulf  !

P. O. Box 756 Port Gibson, MS 39150 Gentlemen:

-

SUBJECT: NRC INSPECTION REPORT NO. 50-416/92-24 Thank you for your response of December 4,1992,'to our Notice of Violation-issued on November 12, 1992, concerning activities conducted at your Grand Gulf facility. We have evaluated you'r response and have found that lt meets the requirements of 10 CFR 2.201. We will examine the implementation of;your corrective actions during future inspection *

As discussed during a December-22, 1992 teleconference between Mr. M. Meis'ner,-

Director of Nuclear Safety and Regulatory Affairs of-your-facility and-Mr. W. Cline, Chief, Radiological Protection and Emergency Preparedness Branch, NRC, Region II, we appreciate your comments and concerns with'the inspection finding as identified in y3ur ' response. The response noted aL

" concern over the use of a new staff position"Jas evidenced by the staff's reference to NRC Information Notice (IN) 92-62 in the Inspection ReportL details. You also noted a " lack of appropriate review of= the subject IN" -

which resulted in an inconsistency in the. definition-of "immediate," (15 minutes) in the cited requirement, compared to "an analogous situation"-

specified in 10 CFR 50.72 (not to exceed one hour), Finally, the re'sponse-stated that "the inspectors shoul_d ~not- have applied the criteria ~ det.?iled in IN 92.62" considering- the time' interval between ' issuance of the. IN and_ the-

-inspectio '

Following the December 22,1992 teleconference, your concerns were reviewed:by

-.NRC Region II management. Upon-review of our; inspection report, it was'note that the discussion of IN 92-62 was presented-in such a ma.ner that it could be interpreted as establishing a requirement. - An IN cannot'. imp.os ._

requirements, but typically. provides additional guidance for or 'a reminder of existing. requirements. In this case, our review determined that the-L , referenced-IN did not represent a new staff position, but the-15 minutes-referenced an expected response time within which appropriate information

-

would be provided to emergency responders; The referenced NRC IN received:

considerable review within both the NRC and Department of Transportation (DOT)

organizations for consistency and for verification that the intent of the underlying regulation (49 CFR -.172.604) was stressed. Compliance _with:

49 CFR 172.604 has been inspected for other NRC RII licensees both before_-

and/or after issuance of the subject IN and, in all- cases, the same evaluat ~

, criteria were used for each license i \
