Re: In the Matter of Pacific Gas and Electric Company (Diablo Canyon), Docket Nos. 50-275, 50-323 (Security Plan)

Gentlemen:

Pursuant to your recent order (ALAB-600), this is to confirm that arrangements for mailing, delivery, etc. of security materials were agreed upon in a telephone conference between Yale I. Jones, James Tourtellotte and myself on Wednesday, July 2, 1980. My apologies for not transmitting that agreement to you sooner but mistakenly, given hindsight, I had intended to await the Board's ruling on Governor Brown's participation in these proceedings and further scheduling before doing that.

It was agreed that all correspondence, such as this lettbE would be sent to lead counsel for the parties and the Board via the U.S. mails with all envelopes marked " Personal and Confidential".

It was further agreed that any testimony, security -

plan information, or other similarly sensitive material would be couriered from the Pacific Gas and Electric. Company building by a Pacific Gas and Electric Company employee to Washington", D.C.

for hand-delivery to the Commission or Staff. This agreement did not, of course, contemplate Mr. Brown's participation on behalf of Governor Brown and it would obviously be folly to e' require Mr. Brown to deliver his materials from Washington, D.C.

to the Applicant in San Francisco for d.elivery by courier to the Staff and Commission in the Washington area. ], g3 The undersigned would therefore suggest that the - 5 1 stipulation stand as between Applicant,- Intervenor San Luis - l Obispo Mothers for Peace and the Staff.-- As for Mr. Brown,_it - /Q 8 0 0 9 2 2 0$2/3' g ]

Reed Johnson July 17, 1980 Page Two would seem that it would be reasonable for him to hand-deliver any such documents to the Appeal Board, Staff and the offices of Pacific Gas and Electric Company located in Washington, D.C. As to how Mr. Brown would transmit materials to the other Intervenor, San Luis Obispo Mothers for Peace, we would ask that those two parties get together and advise us as to how they intend to carry that out. We would only ask that the sensitive materials be hand-delivered and not placed in the United States mail. It is our understanding that ;ir. Jones is on extended vacation until mid August and we have therefore been unable to contact him to discuss the matter further.
